New AI Transparency Requirements: OAIC Releases Resources Ahead of December Deadline
Introduced under the Privacy and Other Legislation Amendment Act 2024, the changes require APP entities to disclose in their privacy policies when computer programs use personal information to make, or substantially contribute to, decisions that could significantly affect an individual’s rights or interests.
Under APP 1.7 and 1.8, organisations must outline the types of personal information used and the categories of decisions involving automated processes. The requirements aim to improve transparency and accountability as AI and automated technologies become increasingly embedded in organisational decision-making.
To support compliance, the Office of the Australian Information Commissioner (OAIC) has released updated guidance, fact sheets and a decision-making flowchart, informed by feedback from 90 consultation submissions.
For records and information management (R&IM) professionals, these changes reinforce the importance of understanding how personal information is collected, managed and used within automated systems. Organisations should review their information governance practices, identify relevant automated decision-making processes and ensure privacy policies meet the new requirements ahead of the December deadline.
